For a judge to hold a fair trial salary, of course, is not an important factor.
Such a point of view was expressed by the presiding judge of FRG Hamburg region Marcus Schneider, answering the question of “First News and Analyses” how important is a judge’s salary to hold fair trials, because salaries of the RA judges were raised, but there is still no justice.
According to Schneider, judges in Germany are well paid, but not very high. If you compare it to the lawyers’ salary, the salary of judges is much lower.
“Both in case of a judge, and a police officer there is a danger of corruption if their salaries are low, while corruption is less possible in the case of a high salaries.” said German judge.
To the question whether German judges are responsible for the cases, by which the state is losing in the ECHR, Mr. Schneider answered, “There must be violations of the law in order to punish the judge, the requirements are very high, and only in this case we can punish him. ECHR decisions should be applied in every single country. Only the fact that the decision is wrong does not say thet there is a violation of the law.”
