The Euro Council’s resolution on Safarov case confirms by accurate definitions that Baku has not only done a conspiracy, but also broke all the verdicts of European Court of Human Rights (ECHR). The editor in chief of “Azdak” paper Shahan Gantaharyan analyzed each of the six points of the resolution.
The European Parliament:
1. Deplores the hero’s welcome accorded to Mr Safarov in Azerbaijan and the decision to promote him to the rank of major and pay him eight years’ back salary upon his arrival, and is concerned about the example this sets for future generations and about the promotion and recognition he has received from the Azerbaijani state.
By the first point Euroepan parliament indirectly condemns the pardon-glorification, though the word “deplore” is used, anyhow the statement of condemning is clear.
2. Expresses its support for the ongoing efforts of the European External Action Service (EEAS), the EU Special Representative for the South Caucasus and the Member States to defuse tensions and ensure that progress is made towards peace in the region
Though the point urges the two parties to turn to peaceful means citing the classical method of mutual responsibility, observing the statement one can notice in the depths of the point, that the resolution confirms that negotiation process is disturbed, even ceased.
3. Reiterates its position that the association agreement currently being negotiated between the EU and Azerbaijan should include clauses and benchmarks relating to the protection and promotion of human rights and the rule of law.
The reminder is for Azerbaijan, the party glorifying the murderer, urging to follow the agreement on the protection of human rights.
4. Urges Azerbaijani authorities to make efforts to review the whole judicial system.
The European Parliament has correctly noticed the vulnerability of Azerbaijani legal system. This is a call to Aliyev, who was trying to reach amnesty decree according to Azerbaijani Constitution. This resolution stresses the uncertainty of legal system noticed in Azerbaijan and in Baku’s explanations, which are considered to be not legal, and not consistent.
5. Urges Azerbaijan to obey all the decisions of ECHR on the account of their country.
It’s obvious that the point conveys that Azerbaijan has broken the rules of ECHR. Safarov’s present status doesn’t correspond to any verdict of European Court of Human Rights.
6. Instructs its President to forward this resolution to the EEAS, the European Council, the Commission, the respective governments and parliaments of the Republic of Azerbaijan and the Republic of Armenia, the Council of Europe, the OSCE and the UN Special Rapporteur on human rights and counter-terrorism
The resolution needs to be forwarded to all the bodies, where Azerbaijan is a member.
The resolution doesn’t have an imperative note, and is filled with urges, but anyhow the criticism is obvious towards the violator of human rights.
In the introductory part of the resolution Euro Parliament it is said that pardoning Ramil Safarov so soon questions the real motives of extradition, which doesn’t correspond to the content of the letter to Hungary by the Azerbaijani deputy FM.
The resolution clearly states that Aliyev has lied. It includes priorities for Armenia on legal-political plane.
