The RA representative on international legal issues explained Armenia vs. Azerbaijan and Azerbaijan vs. Armenia court cases being examined at the International Court of Justice.
“Within the framework of the International Convention on the Elimination of All Forms of Racial Discrimination, Armenia vs. Azerbaijan and Azerbaijan vs. Armenia, which are being examined at the International Court of Justice, Armenia submitted its complete claim against Azerbaijan to the Court on January 23, while also receiving Azerbaijan’s entire claim against Armenia.
According to the Rules of the Court, states have the right to submit preliminary objections (Preliminary Objections) to the other party’s complete statement of claim within three months of receiving it. With preliminary objections, the states raise arguments and justifications regarding the Court’s lack of jurisdiction and the claims’ inadmissibility.
After receiving preliminary objections, the Court, by its Rules, suspends the examination of the case’s merits until a decision is made on the preliminary objections.
On April 21, Armenia submitted preliminary objections to Azerbaijan’s claim within the specified period. The primary objections presented by Armenia refer to most of the shares in Azerbaijan’s pleadings. At the same time, Armenia also received the preliminary complaints presented by Azerbaijan regarding the claim submitted by Armenia.
The parties have the opportunity to present their observations regarding the preliminary objections presented by the other party within the time limit to be set by the Court,” the public explanation states.
