On August 27, the head of the RA NA “Heritage” faction Ruben Hakobyan on behalf of the Committee applied to the Human Rights Defender of RA with a request to litigate the constitutionality of the article 60 Electoral Code of the RA Constitutional Court.
RA NA “Heritage” party press service informed “First News and Analyses” that the reason to apply to the Human Rights Defender for Article 30 part 1 of the RA Constitution is: “eighteen years old citizens of the Republic of Armenia have a right to vote and participate in referendums, as well as right to participate directly and through freely elected representatives of the state administration and local self-government.” and for article 60 part 1 of the Electoral Code is: “In case being out of the Republic of Armenia at the day of election, the Republic of Armenia’s diplomatic service diplomatic or consular representations being abroad with their family members may be eligible to participate in national elections.”
This means that Article 60 of the RA Electoral Code does not allow other citizens being or living abroad to use their constitutional right.
So, on one hand the Constitution gives 18 years old citizens the right to vote, on the other hand the Electoral Code limits the voting outside of the country.
That is why the faction applied to the Human Rights Defender to litigate the constitutionality of the above mentioned contradiction in the RA Constitutional Court.
